Margulies is part of a legal team that has filed litigation for two British and two Australian detainees at the request of their families. He said the state of legal limbo that exists for those at Guantanamo is the result both of haphazard circumstance as well as the astute legal maneuvering of prosecutors in the Department of Defense. Prosecutors claim that while the United States asserts a claim to the base at Guantanamo as U.S. territory, its sovereignty is in question and therefore those held there are not subject to American laws or constitutional protections, and that, in fact, no court has jurisdiction to hear the cases of the detainees.
