Attainder is the practice of legislating guilt and punishment in the absence of a Jury's permission. The Constitution contains in Article I, Section 9, eight specific prohibitions on congressional action. The specific prohibition against Attainder is contained in the the third clause.

The Defense Department policy narrated above are the processes by which ALL SERVICE MEMBERS, civilians, and foreign nationals are brought to U.S. military hearing rooms--UNARMED--to discover what the President of the United States/Commander-in-Chief will decide upon receipt of those recommendations received from his surrogate commanders, who are under the CINC's orders.

The "military proceedings," the courts-martial, military tribunals and commissions are the places innonce goes to die.

Innocence does not exist in the world of attainder.

Hutchins, Girouard, Holt along with every other U.S. warrior presently are congressional prisoners of war. They're entombed behind rocks put in place under presidential order as the commander-in-chief. Federal legislators such as those listed here, although constitutionally forbidded to do so, empowered the President to forever imprison free men, to exercise the power of attainder!

JAMES H. CONNOLLY testifies in Marine's court-martial

"CAMP PENDLETON: A military investigator said his reaction was 'Holy crap!' when he learned that a member of a Marine squad had admitted to helping abduct and kill a defenseless Iraqi man in April 2006, according to testimony yesterday.

James Connelly (sic) said that until that moment, he didn't believe the squad could have done such a thing. Connelly is a special agent for the Naval Criminal Investigative Service."

Jim Connolly is a known and reported federal felon. He's been reported a criminal (with hundreds of accomplices) to the NCIS, Defense Criminal Investigative Service (DCIS), FBI and others for years, years, and years.

Jim Connolly is a liar. NCIS cohort henchmen Ernest "Ernie" A. Simon and Scott Jacobs are criminally complicit. Nearly 50 NCIS agents and a few Army CID agents are presently identified as criminal thugs.

Then we have tens of criminals in high command who are currently outed and thus far similarly immune.

Still no arrests nor prosecutions of federal agents who've locked up innocent men like Staff Sergeant Raymond Girouard, Marine Lance Corporal Kevin Holt, Army Private Corey Cox, Gary Shafto, all of the Camp Pendleton Eight, Edward Richmond, and thousands of other military personnel.

As previously reported in these JAG HUNTER pages, no legal standard exists allowing for military detectives working for the NCIS (or Army CID or Air Force OSI or Coast Guard Investigative Service) to be brought to consequence for their criminal conduct.

And Congress abrogated its oversight duties over two centuries ago.

U.S. Attorney John Mckay was working aggressively on the Law Enforcement Information Exchange program (LInX) in March 2005 when I filed my criminal complaint against NCIS Special Agent James H. Connolly. Connolly worked out of the Silverdale, Washington Pacific Northwest regional NCIS headquarters. Special Agent Scott Jacobs was in charge at the time, Conolly's boss.

The Naval Criminal Investigative Service had resurrected the LInX program by providing funding the DOJ was hard pressed to pony up. SAC Scott E. Jacobs worked on the prototype LInX program using the Pacific Northwest geographic footprint as the initial test bed. NCIS, in fact, had taken the lead on the LInX project. Scott Jacobs was the NCIS program manager working closely with McKay. (More ABOUT LInX here and POWER POINT PRESENTATION here)

I filed my criminal complaint against Connolly with the local Silverdale office of the FBI (Special Agents Patrick Gann and Stephanie Gleason - both still here). Pursuing the criminal complaint against Connolly ran the risk of focusing bright sunlight on the operation of the NCIS in local communities (local policing), and on their overall operation. More than that, my criminal complaint opened up the door on an investigation into a much larger criminal business, and was sure to seriously threaten, if not quash outright the planned launch of the LInX program. So the FBI (DOJ), the NCIS, and the DODIG ignored and stonewalled the complaint of a felony crime.

Special Agent Scott E. Jacobs was handsomely awarded by way of promotion for his successfully development and launch of LInX. Navy admirals awarded U.S. Attorney John McKay, before getting fired, the highest citation that can be given a civilian. Special Agent Ernest A. Simon holds an equivalent NCIS management position for criminal investigations.

NCIS Special Agent James H. Connolly is the supervisory special agent in charge of the Camp Pendleton Eight (HAMDANIA, IRAQ) investigation and is expected to testify in a matter of days in the court-martial of Marine Sgt. Lawrence Hutchins that begins tomorrow.

Tim has worked relentlessly on the side of U.S. Marines in their running gun-battle with the Naval Criminal Investigative Service (NCIS).

NCIS SPECIAL AGENT JAMES H. CONNOLLY IS NAMED HERE, ONCE MORE, AS A PARTICIPATING FELON IN THIS AND OTHER CONTEMPORANEOUS LONG-RUNNING CRIMINAL BUSINESS.

CONNOLLY REMAINS UNDER A TWO-YEAR OLD FEDERAL CRIMINAL COMPLAINT FOR ATTEMPTED INTIMIDATION, AND COMMUNICATING THREATS OF PHYSICAL HARM (WITH OTHER NCIS HENCHMEN), IN A STRONG-ARM ATTEMPT TO PROTECT THE WELL-KNOWN MILITARY PRACTICE OF COERCING CONFESSIONS FROM INNOCENTS. CONNOLLY, lead investigator in the Camp Pendleton Eight cases, rigged the evidence (with his NCIS playmates) as a matter of accepted NCIS procedure. Proofs of NCIS outlawry have become as ubiquitous as they are now in public view in the war the NCIS is waging against our young Marines in service to political expedient.

Attorney John Kivlin, staffer to Congressman William Delahunt (Sgt. Hutchins' representative), said to Sergeant Harrington that although, "no man should be charged with the crime of murder in combat," still admits that Sgt. Hutchins is pronounced guilty before his court-martial ceremony, with only the length of imprisonment left to determine.

Folks, among so many others, such as Kivlin, Delahunt, Congressmen Norman D. Dicks, John Shadegg, Duncan Hunter, John Duncan, Jay Inslee, Walter B. Jones all know the military discipline is badly broken (as reported out by the COX COMMISSION in May 2001). So do Senators Ted Kennedy, Patty Murray, Maria Cantwell, John McCain, Jon Kyl, and John Kerry know the fix is in.

The complicity of most media outlets, those using Marines to profile liberal press political agendas, is outrageous.

Physical evidence in the CP8 nightmare is a hash, every bit of it manufactured, none of it able to survive scrutiny outside the military establishment. It's reported to Tim Harrington by individuals tied to the CP8 case, for instance, that photographs of "the body" produced in last week's Trent Thomas general court-martial are different from those used to coerce plea deals from the other four Marines and Navy Corpsman.
