Senator Graham accepts ruling he can't be military judge

"...the U.S. Court of Appeals for the Armed Forces ruled on Thursday that Graham's service as a judge violates the Constitution which prohibits members of Congress from also holding another United States office."

Does the court's decision suggest that members of Congress cannot lawfully serve in the military reserves as an officer?

That is an issue which should be clarified.

JAG Hunter here: Members of Congress are lawfully prohibited from simultaneously serving in the armed forces. The obvious conflict identified by the U.S. Court of Appeals for the Armed Forces (U.S. CAAF or just CAAF) burdens as much Congressman Steve Buyer as it does Senator Graham.

An indivudual may leave Congress and serve, then return to Congress if they choose. And an individual may have once served in the military, and run for and hold office afterwards. Many candidates running today are Veterans of the current, ongoing conflicts.
