From the fall of the Berlin Wall and the collapse of the Soviet Union up until the morning of Sept. 11, 2001, we were on a holiday from history.
JAG Hunter here: That level of mortal combat that when concluded a nation or its government or both fall dead next to its soldiers may come to America once again. History informs us to be prepared for it.
There may come a time when we must employ the Articles of WAR as they are meant to operate. We will be forced to close our courts on that day if that day ever arrives.
That day, however, is not today.
And the operation of the Articles of WAR in time of peace is an illicit act of attainder. We are commanded by the Constitution to use our courts when they are open.
Today, the courts are functioning. I predict they'll be open tomorrow.
