JAG Hunter here: Congress does not need to form a new type or kind of military tribunal (or commission) protocol to determine whether enemy belligerents rate punishment for criminal acts alleged to date. When the chief executive, as commander in chief, declares enemy personnel collected from the battle space--in time of War--as Prisoners of War, those prisoners immediately come under the jurisdiction of America's Articles of War (renamed the Uniform Code of Military Justice-UCMJ-over 50-years ago).
POWs may be brought before courts-martial as quickly as our governent can make that happen.
